Terms of service
Last updated: October 25, 2026
These Terms of Service ("Terms") apply to your use of kineticdevteam.com and to any services or products you buy from Kinetic Development ("we", "us"). By using the site, requesting a quote or placing an order, you agree to these Terms. If you don't agree, please don't use the site or our services.
1. Our services
We offer website design and development, admin portals, hosting and care plans, FiveM development (custom scripts, conversions, fixes and server setup), and related services. Every service page describes what's included. For custom work, the agreed quote, invoice or payment link (together, the "Quote") sets out the exact scope, price and timeline. If the Quote and these Terms conflict, the Quote wins for that project.
2. Quotes and orders
- Quotes are valid for 30 days unless they say otherwise.
- An order is confirmed once we receive payment, or the agreed deposit, through checkout or a payment link.
- We may decline or cancel any order before work begins, for example if a request is outside what we do or breaks these Terms. If we cancel, we'll refund anything you've paid for that order.
3. Payments
- Prices are shown in the currency listed at checkout. Payments are processed by Stripe or PayPal.
- One-time services are paid upfront, or as a deposit with the balance due on completion, as stated in the Quote.
- Subscriptions (such as monthly or yearly care, hosting or support plans) renew automatically at the listed price every billing period until cancelled.
- You're responsible for any taxes or fees your bank or payment provider charges.
- We may pause work, or take down hosted work, if a payment is overdue or a payment is reversed (charged back) without a valid reason.
4. Subscriptions and cancellation
You can cancel a subscription at any time by contacting us, or through your PayPal account for PayPal subscriptions. Cancellation stops future renewals. Your plan stays active until the end of the period you've already paid for. We don't give partial refunds for unused time in a billing period. We'll give you at least 14 days' notice before any price change to an active subscription takes effect.
5. Refunds
Most of our work is custom digital work, so our refund rules are:
- Before work starts: full refund.
- After work starts: deposits are non-refundable, because they cover time already spent. If you cancel partway through, we may keep payment for the work completed so far and refund the rest.
- Delivered and accepted work: not refundable. We'll still fix genuine bugs or problems as described in section 7.
- Free items: no charge, so no refund.
- FiveM scripts bought on our Tebex store follow the refund policy shown on that store. Because scripts are digital downloads delivered instantly, they're generally non-refundable once delivered.
If something isn't right, contact us first. We'd much rather fix the problem.
6. Your responsibilities
- Give us the content, access, logins and feedback we need, on time. Delays on your side can push back the timeline.
- Make sure you have the rights to anything you send us, such as logos, images, text and code, and that using it won't infringe anyone else's rights.
- Keep your own logins, hosting accounts and server access secure.
- Don't use our work or services for anything illegal, harmful, or against the terms of the platforms involved, including Cfx.re/FiveM, Rockstar Games, Discord, Stripe and PayPal.
7. Revisions, delivery and support
- Each Quote states the number of revision rounds included. Extra revisions or new features outside the agreed scope are quoted separately.
- When we deliver, please review the work promptly. If you don't report problems within 14 days, the work is treated as accepted.
- We fix bugs in our own work that you report within 30 days of delivery, at no charge. This doesn't cover problems caused by changes made by you or someone else, third-party updates (such as FiveM, frameworks, plugins or hosting changes), or misuse.
- Ongoing support, updates and maintenance after that are available through a care or support plan, or quoted separately.
8. Ownership and licenses
- Custom websites and custom work: once you've paid in full, you own the final deliverables made specifically for you. Until then, we keep ownership.
- Our tools and reusable code: we keep ownership of our pre-existing code, frameworks, templates, libraries and know-how used in your project. You get a permanent license to use them as part of the delivered work, but you may not resell or redistribute them on their own.
- Third-party components: fonts, images, open-source libraries and similar items stay under their own licenses.
- FiveM scripts from our store: you buy a license to use the script, not ownership of it. Unless the product page says otherwise, you may use it on your own server(s). You may not resell, share, leak, re-upload, or try to decrypt or bypass the asset escrow protection. Breaking these terms can lead to your license being revoked without a refund. Cfx.re's asset escrow terms also apply.
- Portfolio: we may show finished work (screenshots, a link and a short description) in our portfolio and marketing, unless you ask us in writing not to.
9. Hosting and third-party services
If we host or manage your site or server, we use third-party providers, such as Hostinger, and their uptime and policies apply. We work to keep things running but can't guarantee uninterrupted service. We aren't responsible for outages, data loss, price changes or policy changes by third parties, including FiveM/Cfx.re, Tebex, Discord, Stripe, PayPal and hosting providers. Keep your own backups of anything important.
10. Confidentiality
We'll keep private any non-public information you share with us for a project, such as logins, business details and unreleased plans. We'll use it only to do your work. We'll ask you to change passwords and remove our access when a project ends, if needed.
11. Disclaimer
Apart from what these Terms or your Quote expressly promise, the site, services and products are provided "as is", without warranties of any kind, express or implied. That includes merchantability, fitness for a particular purpose and non-infringement. We don't guarantee particular results, such as search rankings, traffic, sales or player counts.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim related to a service or product is limited to the amount you paid us for that specific service or product in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
You agree to cover us against any claims, losses or costs, including reasonable legal fees, that come from content or materials you provided, your misuse of our work or services, or your breaking these Terms.
14. Termination
Either of us can end a project or the relationship by written notice. You'll pay for work completed up to that point, and section 5 applies to any refund. Sections 8, 11, 12, 13 and 16 continue to apply after termination.
15. Privacy
Our Privacy Policy explains how we handle your personal information.
16. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-law rules. If a dispute comes up, please contact us first so we can try to resolve it informally. Any dispute that can't be resolved will be handled in the state or federal courts located in Pennsylvania.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes don't apply to orders already placed under an earlier version.
